Terms of Use and Acceptable Use

1. Agreement
By installing or using Mail Tracking, a Chrome extension hosted by SentCue, you agree to these Terms. If you do not agree, do not install or use the extension. These Terms include the Privacy Policy.
2. The service
Mail Tracking is a Chrome extension for Gmail on the web. It may add a tracking image to messages you choose to track and show activity signals in Sent. A signal is not proof of reading, delivery, or that a particular person opened the message. We do not provide email transport; Gmail still sends the mail.
v1 does not require a Mail Tracking or SentCue account, does not use the Gmail API or Google OAuth, and does not support Scheduled Send, Outlook, or the Gmail mobile apps.
3. Not affiliated with Google
SentCue is independent and is not affiliated with, endorsed by, or sponsored by Google LLC. “Gmail” and “Google” are trademarks of Google. We mention Gmail only to describe where the extension runs.
4. Email tracking — your role as controller
When you turn tracking On, you act as the data controller (or equivalent) for personal data relating to your recipients. SentCue acts as a technical processor for token, timestamps, and coarse client class, only to provide the feature. You instruct us to process that data by enabling tracking after the disclosure.
You are solely responsible for complying with privacy, ePrivacy, employment, marketing, and communications laws that apply to your messages. That may include informing recipients, obtaining consent where required, and answering their access or deletion requests. Some authorities treat invisible tracking pixels as requiring prior consent. We do not automatically disable tracking for EU or other regions. We cannot fulfil recipient rights requests in the sender’s place.
5. Acceptable Use Policy
You may not use Mail Tracking to:
- stalk, harass, or covertly surveil a person;
- monitor children;
- covertly monitor employees or other people without a lawful basis and any required notice;
- use tracking as a surveillance tool on medical or similarly sensitive communications;
- run bulk unsolicited outreach whose purpose is hidden tracking;
- attempt to access another user’s install, tokens, or our systems without authorization;
- interfere with or reverse-engineer the service in a way that harms others or evades the kill switch.
We may disable tracking globally (kill switch) or refuse support if we reasonably believe these rules are broken.
6. Your other responsibilities
- Keep your Chrome install and Gmail account under your control.
- Do not upload or send unlawful content through Gmail while using the extension.
- Understand that scanners, proxies, and self-opens can create or hide signals.
7. No warranty
THE SERVICE IS PROVIDED “AS IS”. We do not warrant that signals are complete, accurate, timely, or that they correspond to a human read. Nothing here is legal, employment, or deliverability advice.
8. Limitation of liability
To the maximum extent permitted by law, SentCue and its operator are not liable for lost business, follow-up decisions based on signals, or indirect or consequential damages. Nothing excludes liability that cannot be excluded (including fraud or liability that mandatory consumer law preserves). Our total liability for a claim relating to the free v1 service shall not exceed USD 100.
9. Intellectual property
The extension, site, and SentCue name are owned by the operator. You keep rights in your own email content. We do not claim ownership of Gmail or of messages you send.
10. Changes and termination
We may change these Terms; the effective date will update. We may withdraw the service or the kill switch. You may stop using Mail Tracking by turning tracking Off, deleting install data, and uninstalling the extension.
11. Governing law
These Terms are governed by applicable law excluding conflict-of-law rules. The operator’s jurisdiction will be stated when the legal entity is named. Mandatory consumer protections in your country still apply.
